Official Contest Rules

Description of the Contest

The Dare to Be You Contest is designed to encourage Gossip swimsuit lovers to use their creativity and submit photographs that adhere to the theme “I Dare to ____.” Judges will choose the winning entry, and the prize will be awarded in accordance with these Contest Rules.

Sponsor

The contest is sponsored by Gossip, a division of Malibu Dream Girl, Inc., a California corporation with principal place of business at 4941 S. Eastern Ave., Bell, CA 90201, USA.

Who Can Enter

  1. Entrants must be legal residents of the United States and must be from the ages of 13-29.
  2. Employees of Malibu Dream Girl (Gossip), affiliated companies, and the immediate family members (i.e., spouses, parents, children, grandchildren, and siblings) of each of the above are NOT eligible to enter and/or to win.
  3. In order to enter the Contest, you must agree to these Contest Rules. The Rules consist of the terms and conditions on this page and the Entry Form. If you are a minor, you must obtain the prior permission of your parent and/or legal guardian and your parent and/or legal guardian must also agree to these Rules on their and your own behalf before you can enter this Contest. The Entrant must also have the permission of any other person who is featured in the submitted photograph. You agree that your submission of an entry in the Contest constitutes your agreement to these Rules.

Submissions

  1. No purchase is necessary to enter or win.
  2. Entrants do not need to be wearing Gossip swimsuits in their photographs.
  3. The contest will run from May 5–June 7, 2010. There will only be one winner chosen.
  4. Entrants must fill out all required fields on the Entry Form and submit their photograph. All entries must be uploaded electronically via the Entry form to be considered valid. Any other entries sent by means other than electronic form will not be considered eligible entries. Submissions must be received by Malibu Dream Girl no later than 11:59PM Pacific Time (PT) on June 7, 2009 to be considered eligible.
  5. Malibu Dream Girl is not responsible for any entries that are misdirected, lost, not received, or are illegible.
  6. Each Entrant may submit only one photo.
  7. Each entrant agrees not to participate in the Contest in any manner that might (1) infringe any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violate applicable law in any countries in the world.
  8. Entries that are obscene, vulgar, hateful, threatening, or violate any laws will not be accepted, and the person making such an entry will be barred from further participation in the contest.
  9. All entries become the property of Malibu Dream Girl and will not be acknowledged or returned.
  10. Malibu Dream Girl reserves the right to prohibit an entrant from participating in a contest or receiving a prize if, in its sole discretion, it determines that said entrant attempted to undermine the legitimate operation of the contest by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten, or harass any other entrants or company representatives.
  11. By participating in this Contest, entrants agree and hereby consent Malibu Dream Girl permission to use, copy, modify and make available their submissions to the public (with or without attribution to them) for any purpose, such as, but not limited to, press and media communications, without further compensation to the entrants.

Prize

  1. The winner of the Ultimate Beach Bag giveaway will receive a Gossip beach tote filled with goodies: 2 Gossip swimsuits, t-shirt, and notepad. The prize will be mailed to the contest winner’s address as provided on the Entry Form.
  2. The winner’s photograph will be marked as the winner on the Gossip website for three months or less.
  3. Malibu Dream Girl reserves the right to substitute a prize of equal or greater value for all contests and giveaways. Prizes are not redeemable for cash. No substitution, transfer or assignment of prizes is allowed.

Odds of Winning/Miscellaneous

  1. All valid entries will be judged by the Contest Staff based on the following criteria: 1) Creativity, 2) Adherence to the Theme and 3) Adherence to the Rules.
  2. Winner will be listed on the website and notified by phone, e-mail or United States mail. Any potential winner who cannot be contacted within fifteen (15) days of attempted first notification will forfeit his or her prize. Failure to comply within this time period may result in disqualification and selection of an alternate winner.
  3. The contest is subject to all applicable laws and regulations and are void where prohibited. Malibu Dream Girl accepts no responsibility of liability in connection with any injuries, losses or damages of any kind caused by or resulting from (a) participation in the contest and/or (b) the acceptance, possession and/or use of any prize awarded hereunder.
  4. Malibu Dream Girl reserves the right to change, alter or modify these rules at any time with or without written notice.
  5. All entrants agree to release, discharge, indemnify and hold harmless Malibu Dream Girl, its employees, officers, directors, subsidiaries, parent companies, affiliated companies, sponsors, and family members from and against any and all claims, damages or liability due to any injuries, damages, or losses to any person, including death, or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this contest.
  6. Malibu Dream Girl Contest Staff shall be the sole arbiters in all matters relating to the contest and the interpretation of contest rules. The decisions of Contest Staff shall be final.
  7. In the event there are not enough eligible entries, the prize will not be awarded. If the winner is not able to for whatever reason to accept her prize, Malibu Dream Girl reserves the right to award the prize to another Entrant.
